Pepcision, LLC, a Florida limited liability company ("Pepcision," "we," "us," or "our") provides this Consumer Health Data Privacy Policy ("Policy") to describe how we collect, use, disclose, and protect Consumer Health Data in connection with the Platform and Service. This Policy supplements our general Privacy Policy and applies to the extent required by applicable state consumer health data laws.
This Policy does not replace or supersede:
- The Notice of Privacy Practices issued by our independent telehealth partner Arora and its licensed healthcare providers ("Providers"), or
- Any HIPAA obligations that apply to Arora, the Providers, or the dispensing pharmacy.
For information about how your medical records, treatment information, and Protected Health Information (PHI) are handled in the context of clinical care, please refer to Arora's Notice of Privacy Practices, which is provided during the telehealth process or available upon request from Arora.
What is Consumer Health Data?
"Consumer Health Data" generally refers to personal information that identifies or is reasonably linkable to you and that relates to your physical or mental health status, medical history, symptoms, diagnoses, treatments, medications, or health-related decisions, as defined under applicable state laws (such as Washington's My Health My Data Act and similar laws in other states).
This includes, for example:
- Health-related information you provide when requesting or participating in telehealth consultations through the Platform.
- Wellness goals, symptoms, medical history, or product preferences you voluntarily submit in connection with wellness or peptide products.
- Information about prescriptions or health-related products you order through the Platform.
- Certain inferences we may draw about your health from your activity on the Platform.
Note: Clinical records created or maintained by Arora and the Providers in connection with medical treatment are primarily governed by Arora's Notice of Privacy Practices and applicable healthcare privacy laws (including HIPAA where it applies). Pepcision's collection and use of Consumer Health Data is generally limited to platform facilitation, coordination, and non-clinical wellness purposes.

- Usage data and inferences that may relate to health or wellness interests (e.g., pages viewed, products considered).
We do not collect genetic information, biometric data for identification purposes, or other highly sensitive categories of health data unless you voluntarily provide it in connection with the Service.

We collect Consumer Health Data:
- Directly from you when you use the Platform, complete forms, request consultations, or make purchases.
- From Arora and its Providers, with appropriate safeguards and agreements in place, to facilitate the Service.

- Processing and fulfilling orders for wellness and health-related products.
- Personalizing product recommendations and wellness content based on your stated goals and activity.

We do not use Consumer Health Data to make decisions about your eligibility for credit, employment, or insurance, or for any discriminatory purpose.
How We Share and Disclose Consumer Health Data
We share Consumer Health Data only as necessary and in the following circumstances:
- Arora and Providers: To enable telehealth consultations, medical evaluations, and the issuance of prescriptions. This is the primary way health-related information is used for clinical purposes.
- Pharmacy Partners: Limited information necessary for the Pharmacy to fill and ship prescriptions in accordance with the Provider's orders and applicable pharmacy law.
- Service Providers: With vendors and contractors that help us operate the Platform (e.g., hosting, analytics, customer support, or marketing services). These parties are subject to contractual confidentiality and data protection obligations.
- Legal Requirements: When required by law, court order, or government request, or to protect the rights, safety, or property of Pepcision, our users, or others.
- Business Transfers: In connection with a merger, acquisition, or sale of assets, subject to appropriate protections for your information.
- With Your Consent: When you direct us to share your information or otherwise provide consent.
We do not sell Consumer Health Data for monetary or other valuable consideration. We also do not share Consumer Health Data for cross-context behavioral advertising or targeted advertising in a manner that would constitute a "sale" or "sharing" under applicable state consumer health data laws, except where you have been provided clear notice and an opportunity to opt out (if required).
Your Rights Regarding Consumer Health Data

- Right to Withdraw Consent: Where processing is based on consent, withdraw that consent at any time.
- Right to Non-Discrimination: Exercise your rights without being discriminated against.
To exercise these rights, please submit a request using the contact information below or through any designated privacy request form on the Platform. We will verify your identity and respond within the timeframes required by applicable law. If you are submitting a request on behalf of another individual, we may require authorization documentation.
Note: For clinical health records and treatment-related information held by Arora and the Providers, you should direct your requests to Arora in accordance with their Notice of Privacy Practices.
Data Security
We maintain reasonable technical, administrative, and physical safeguards designed to protect Consumer Health Data against unauthorized access, use, or disclosure. These safeguards are consistent with or exceed the protections described in our general Privacy Policy, with heightened attention given to the sensitivity of health-related information.
Data Retention
We retain Consumer Health Data only for as long as necessary to fulfill the purposes described in this Policy, to provide the Service, to comply with legal obligations (including healthcare record retention requirements where applicable), or to resolve disputes. When retention is no longer necessary, we securely delete or de-identify the data.
Changes to This Policy
We may update this Consumer Health Data Privacy Policy from time to time. We will post the updated version on the Platform with a revised "Last Updated" date. Material changes will be communicated as appropriate. Your continued use of the Platform after any update constitutes acceptance of the revised Policy.

BY CLICKING "I AGREE," CHECKING A BOX, USING ANY OTHER ACCEPTANCE MECHANISM PRESENTED ON THE PLATFORM, OR OTHERWISE AFFIRMATIVELY ACCEPTING THESE TERMS, OR BY ACCESSING OR USING THE PLATFORM OR SERVICE IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS (THE "AGREEMENT" OR "TERMS"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CREATE AN ACCOUNT, ACCESS, OR USE THE PLATFORM OR SERVICE.
These Terms constitute a binding legal agreement between you ("you," "your," or "User") and Pepcision, LLC, a Florida limited liability company, and its affiliates and subsidiaries (collectively, "Pepcision," "we," "us," or "our"). Pepcision owns and operates the website located at www.pepcision.com (or any successor or related domain) and any associated mobile applications, software, or other digital properties (collectively, the "Platform"). Your access to and use of the Platform, any Content (as defined below), and any products, services, or features offered through or in connection with the Platform (collectively, the "Service") are governed by this Agreement.
This Agreement includes and incorporates by reference our separate Privacy Policy, which governs our collection, use, and disclosure of personal information. Capitalized terms not defined here have the meanings set forth in the Privacy Policy or elsewhere in this Agreement.
1. Acceptance of Terms and Changes to Terms
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. We may modify these Terms at any time by posting the updated version on the Platform. Material changes will be effective upon posting or as otherwise indicated. It is your responsibility to review these Terms periodically.
If you do not agree to any modification, you must stop using the Service immediately. Your use of the Service is also subject to all applicable federal, state, and local laws and regulations.
2. Eligibility, Age, and Geographic Restrictions
The Service is intended solely for use by individuals who are:
- At least eighteen (18) years of age or the age of majority in your jurisdiction of residence (whichever is older); and
- Residents of the United States; and
- Located in a jurisdiction within the United States where the Service is legally available and not prohibited or restricted by applicable law or regulation.
By using the Service, you represent, warrant, and covenant that:
- You are a legal resident of the United States;
- Your shipping address is located within the United States (we do not ship internationally or to addresses outside the United States);
- You are not located in, or a resident of, any country or jurisdiction subject to U.S. sanctions or embargoes;
- You will comply with all applicable laws regarding the purchase, possession, and use of any products obtained through the Service; and
- You have the legal capacity and authority to enter into this Agreement and to use the Service.
We reserve the right, in our sole discretion, to refuse service, cancel any order, suspend or terminate your account, or limit the availability of the Service in any jurisdiction where doing so is required or advisable due to legal, regulatory, or operational considerations. Availability of specific products, telehealth services, or pharmacy fulfillment may vary by state due to licensing, prescribing, compounding, or telehealth regulations.
The Service is not available to individuals under 18 (or the applicable age of majority). We do not knowingly permit use by minors.
3. Description of the Service and Your Relationship with Third Parties
Pepcision operates a web-based platform that allows consumers to browse, purchase, and receive wellness products, including peptide products and related compounds ("Products"). The Platform also facilitates access to telehealth services provided by an independent third-party telehealth provider group: Arora Health and Aesthetics HUB, P.A. (a Florida corporation); Arora Health of CA, PC; Arora Health of NJ, PC; Arora Health of NY, PC; and Arora Health of KS, PC; each entity, respectively, a Florida, California, New Jersey, New York, and Kansas professional association, collectively with a business office located at 300 Lenora Street, Suite #958, Seattle, WA 98121 (collectively "Arora") and its licensed healthcare providers (each a "Provider"). When a Provider issues a prescription, it is filled and shipped directly by an independent licensed 503A compounding pharmacy (the "Pharmacy").
Important Relationships and Disclaimers:
- Pepcision is not a healthcare provider. Pepcision does not practice medicine, provide medical advice, make diagnoses, issue prescriptions, compound medications, or dispense drugs. Pepcision does not employ, control, or direct Arora, any Providers, or the Pharmacy. There is no doctor-patient or provider-patient relationship between you and Pepcision.
- Arora and the Providers are independent third parties solely responsible for all medical aspects of the Service, including but not limited to telehealth consultations, medical evaluations, clinical decision-making, prescribing (or declining to prescribe), and any follow-up care. All medical care is provided pursuant to Arora's and the Providers' independent professional judgment and in compliance with applicable medical, telehealth, and prescribing laws.
- The Pharmacy is an independent licensed 503A compounding pharmacy solely responsible for receiving valid prescriptions, compounding medications in accordance with the prescription and applicable federal and state pharmacy laws (including USP <797> and <800> standards where applicable), quality control, labeling, packaging, and direct shipping to you. Pepcision does not compound, dispense, or control the Pharmacy's operations.
- Arora, the Providers, and the Pharmacy are third-party beneficiaries of this Agreement with respect to provisions applicable to them and may enforce those provisions directly against you.
- The Service, including any Products (many of which are compounded medications), is provided on a cash-pay basis. We do not submit claims to Medicare, Medicaid, or most private insurance plans for these services and Products. You are solely responsible for all costs and fees.
You acknowledge and agree that:
- Many wellness and peptide Products offered through the Service are compounded medications prepared pursuant to individualized prescriptions for specific patient needs as determined by a Provider. These compounded medications may not be FDA-approved for the particular use for which they are prescribed, may differ in formulation, strength, or excipients from any commercially available FDA-approved products, and carry risks associated with compounding (including, without limitation, potential variability in potency, sterility, or stability, though the Pharmacy is responsible for compliance with applicable standards).
- The safety, efficacy, and appropriateness of any Product or therapy are determined solely by the prescribing Provider based on your individual medical history, presentation, and clinical judgment. Pepcision makes no representations or warranties regarding the regulatory status, safety, efficacy, or suitability of any Product for any particular purpose beyond what is expressly required by applicable law.
- Telehealth has inherent limitations (including the absence of an in-person physical examination). You are responsible for providing complete, accurate, and up-to-date information to Providers.
4. Financial Responsibility and Payment
You are solely and fully responsible for payment of all fees, charges, and costs associated with the Service, including but not limited to consultation fees, membership or subscription fees, Product costs, shipping, taxes, and any applicable service or processing fees. Prices are displayed on the Platform and are subject to change. Applicable taxes and shipping charges will be calculated and displayed at checkout.
Payment is processed through third-party payment processors (e.g., Stripe or similar). By providing payment information, you authorize us and our processors to charge the applicable amounts. Subscriptions and recurring services (if offered) automatically renew unless canceled in accordance with the cancellation procedures disclosed on the Platform or in your account settings. You may cancel recurring services prior to the start of the next billing cycle; however, we do not provide prorated refunds for partial or pre-paid periods or for Products that have been shipped or prepared. Limited exceptions may apply in our sole discretion (e.g., for certain defective Products or as required by law).
5. Subscription Products, Memberships, and Recurring Services; Prescription Products
Certain wellness Products and services, including peptide therapies, are available through subscription or membership plans that provide recurring access, shipments, or services. Details of each plan (including billing cadence, included services, and cancellation terms) are disclosed on the Platform or during the signup/checkout process.
Prescription Products (including peptide compounds): Many Products require a valid prescription issued by a licensed Provider following a telehealth consultation facilitated through the Platform. The Platform enables you to request a consultation; Providers independently determine whether a prescription is medically appropriate. Not all requests result in a prescription. If a prescription is issued, it is transmitted to the Pharmacy for fulfillment in accordance with applicable law. You are responsible for reviewing all prescription information, instructions, and warnings provided by the Provider and Pharmacy.
You acknowledge that compounded prescription Products are prepared specifically for you and are generally non-returnable and non-refundable once shipped for safety and regulatory reasons, except as may be required by law or in cases of clear defect or error attributable to the Pharmacy (subject to the Pharmacy's policies and applicable law).
6. Telehealth Services and Informed Consent
By using the Service and requesting or participating in telehealth consultations, you consent to receive telehealth services from Arora and its Providers. This includes video, audio, written or asynchronous (store-and-forward) communications as made available. You acknowledge the limitations of telehealth and agree to:
- Provide accurate, complete, and truthful medical history, current medications, allergies, symptoms, and other information requested;
- Ensure you have appropriate technology, privacy, and connectivity for consultations;
- Understand that telehealth may not be appropriate for all conditions and that a Provider may recommend an in-person evaluation or decline to prescribe;
- Comply with all instructions, treatment plans, and follow-up recommendations from Providers; and
- Review and agree to any separate telehealth informed consent, patient agreement, or Notice of Privacy Practices provided by Arora or the Providers (which may be presented during onboarding or consultation).
Pepcision facilitates the connection and certain administrative aspects (such as record transmission where authorized) but does not control or provide the medical services. By using Arora, you agree to such patient consents as Arora may require.
7. Laboratory and Diagnostic Services (If Facilitated)
Providers may order laboratory testing or other diagnostics as part of your care. Such services are provided by independent clinical laboratories or through at-home collection kits. Results are for use by you and your Provider(s) in monitoring or guiding care. Pepcision does not interpret results or provide medical advice based on them. You are responsible for following up with your Provider regarding results.
8. Your Account, Registration, and Security
You must create an account to access certain features of the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use or suspected breach.
We may suspend or terminate accounts that violate these Terms or for other legitimate reasons.
9. License to Use the Service; Intellectual Property; User Content
Subject to these Terms, Pepcision grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Service for your personal, non-commercial use in accordance with these Terms. All rights not expressly granted are reserved by Pepcision and its licensors.
The Platform, Content (text, graphics, logos, images, software, etc.), and all intellectual property rights therein are owned by Pepcision or its licensors. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service or Content without our prior written consent.
If you submit any content, feedback, reviews, or other materials through the Platform ("User Content"), you grant Pepcision a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute such User Content in connection with the Service and our business. You represent that you have all rights necessary to grant this license and that your User Content does not infringe third-party rights or violate law.
10. Prohibited Uses
You agree not to use the Service to:
- Violate any law, regulation, or third-party right;
- Provide false, misleading, or incomplete information;
- Interfere with or disrupt the Service, servers, or networks;
- Attempt to gain unauthorized access, probe, or test vulnerabilities;
- Upload or transmit viruses, malware, or harmful code;
- Resell, redistribute, or commercially exploit Products or access obtained through the Service;
- Use the Service for any unlawful purpose or in any manner that could harm Pepcision, Arora, Providers, the Pharmacy, or others; or
- Engage in any activity that we reasonably determine is inconsistent with the intended purpose of the Service or these Terms.
We reserve the right to monitor use and to investigate and take appropriate action (including termination and referral to law enforcement) for violations.
11. Third-Party Goods, Services, and Links
The Service may integrate with, link to, or facilitate access to third-party websites, applications, products, or services (including Arora's platform, the Pharmacy's systems, payment processors, shipping carriers, and labs). These are provided for convenience only. We do not control and are not responsible for third-party content, practices, or availability. Your use of third-party services is subject to their separate terms and policies. You release and hold harmless Pepcision Parties from any claims arising from your use of or disputes with third parties.
12. Terms of Sale; Shipping; Returns and Refunds
Products are subject to availability. We reserve the right to limit quantities, refuse orders, or cancel orders for any reason (including suspected fraud, regulatory issues, or unavailability). Risk of loss and title for physical Products generally pass to you upon delivery to the carrier at our or the Pharmacy's facility.
Shipping is available only to addresses within the United States via standard carriers. Delivery times are estimates only. You are responsible for providing accurate shipping information.
Returns and Refunds: Policies are disclosed on the Platform or at checkout. Compounded prescription Products are generally not returnable or refundable once shipped due to safety, quality, and regulatory considerations, except where required by law or in cases of documented defect or shipping error attributable to us or the Pharmacy. Non-prescription wellness Products may have limited return windows as posted. Contact customer support promptly for any issues.
13. Disclaimers of Warranties
THE SERVICE, PLATFORM, CONTENT, AND ALL PRODUCTS AND SERVICES (INCLUDING ALL PEPTIDE AND COMPOUNDED PRODUCTS) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE.
Without limiting the foregoing:
- We do not warrant that any Product will achieve any particular result, that telehealth consultations will be equivalent to in-person care, or that any prescription will be issued.
- Compounded medications and many wellness peptides have not been evaluated by the FDA for safety or efficacy for all uses for which they may be prescribed. The FDA has not approved many such compounds for the specific indications promoted in wellness contexts.
- Medical outcomes depend on numerous individual factors. No guarantee of results is made.
- We disclaim any liability for actions or omissions of Arora, Providers, the Pharmacy, laboratories, or other third parties.
Some jurisdictions do not allow the exclusion of certain warranties; in such cases, the exclusions apply to the maximum extent permitted by law.
14. Limitation of Liability; Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEPCISION OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS (COLLECTIVELY, "PEPCISION PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR SIMILAR DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, PERSONAL INJURY, OR EMOTIONAL DISTRESS) ARISING OUT OF OR RELATED TO THESE TERMS, THE SERVICE, PRODUCTS, TELEHEALTH SERVICES, OR YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amounts you paid to Pepcision in the twelve (12) months preceding the claim or (b) One Hundred Dollars ($100). This limitation applies even if any remedy fails of its essential purpose.
You agree to indemnify, defend, and hold harmless the Pepcision Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Service or Products; (ii) your breach of these Terms or any representation or warranty; (iii) your violation of applicable law; (iv) any User Content you submit; or (v) any dispute between you and Arora, a Provider, the Pharmacy, or any other third party.
15. Termination
We may suspend or terminate your access to the Service or any portion thereof at any time, with or without notice, for any reason or no reason, including but not limited to violation of these Terms, suspected fraud, regulatory requirements, or discontinuation of the Service. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including but not limited to disclaimers, limitations of liability, indemnification, intellectual property, governing law, and arbitration) shall survive termination.
16. Dispute Resolution – Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You and Pepcision agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the breach thereof shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or, if applicable and mutually agreed, JAMS or another mutually selected administrator), rather than in court. The arbitration shall be conducted on an individual basis only; class arbitrations, class actions, private attorney general actions, and consolidation with other proceedings are not permitted. You and Pepcision expressly waive any right to a jury trial or to participate in a class action or representative proceeding.
The arbitration shall take place in Miami-Dade County, Florida (or such other location as the parties may agree or the arbitrator may determine for convenience). The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own costs, unless the arbitrator determines otherwise or applicable law provides otherwise.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to the address or email specified in the "Contacting Us" section within thirty (30) days of first accepting these Terms or creating an account. Your opt-out notice must include your name and a clear statement that you opt out of arbitration.
This arbitration agreement shall survive termination of these Terms. Notwithstanding the foregoing, either party may seek provisional or injunctive relief in a court of competent jurisdiction to protect intellectual property or other rights pending arbitration and claims that are not subject to arbitration under applicable law (e.g., certain small claims) may proceed in court.
17. Governing Law; Venue; Severability
These Terms and any dispute not subject to arbitration shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Subject to the arbitration provision, any legal action or proceeding shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction and venue of such courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
18. Miscellaneous
- Entire Agreement: These Terms (including the Privacy Policy and any other agreements or policies expressly incorporated) constitute the entire agreement between you and Pepcision concerning the Service and supersede all prior or contemporaneous agreements, representations, or understandings (whether written or oral).
- No Waiver: Our failure to enforce any provision shall not constitute a waiver of that or any other provision.
- Assignment: You may not assign or transfer these Terms or any rights hereunder without our prior written consent. Pepcision may assign or transfer these Terms and its rights and obligations without your consent in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all assets.
- Notices: We may provide notices via message, email, through the Platform, or by posting. You consent to receive electronic communications from us. Legal notices to us should be sent to the address or email provided in the "Contacting Us" section.
- Third-Party Beneficiaries: Except as expressly provided (e.g., with respect to Arora, Providers, and the Pharmacy), these Terms do not create any third-party beneficiary rights.
- No Agency or Partnership: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Pepcision. You may not bind Pepcision in any way.
- Export and Compliance: You represent that you are not on any U.S. government restricted party list and will comply with all applicable export and import laws.
- Headings: Headings are for convenience only and do not affect interpretation.
19. Contacting Us
If you have questions about these Terms, the Service, or need support, please contact our customer support through the help center or contact form on the Platform, or email support@margomd.com or such other address as we may designate. We will endeavor to respond promptly.
For medical or prescription-related questions or concerns, please contact Arora or the prescribing Provider directly, as Pepcision does not provide medical advice or handle clinical matters.
ACKNOWLEDGMENT AND AGREEMENT
By using the Service, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the disclaimers, limitations of liability, arbitration agreement, and class action waiver. You further acknowledge that the medical services are provided by independent third parties (Arora and Providers, Pharmacy) and that compounded Products carry specific risks and regulatory considerations as described above.
